Terms and Conditions

Haven Media provides professional real estate photography, videography, floor plans, virtual staging, 3D rendered videos, and drone aerial imagery. The scope and nature of these services are detailed on the Haven Media website. Any additional services or specific client requests must be agreed upon in writing prior to commencement.

• Booking Confirmation: To secure Haven Media’s services for larger projects, including all videography work, a non-refundable deposit of 30% of the total project cost is required at the time of booking.

• All invoices issued by Haven Media are strictly payable within seven (7) days from the date of the invoice. In the event of late payment, a late fee of fifty dollars ($50) per week will be applied until full payment is received.

• Cancellation Policy: In the event that a client cancels a job or appointment without providing at least twenty-four (24) hours' notice, fifty percent (50%) of the total job cost will be due as a cancellation fee. Additionally, if Haven Media arrives at the job address and is unable to access the property or the job is canceled upon arrival, a fee of one dollar ($1) per kilometer, for travel to and from the property, calculated from Mackay CBD, will be charged. This fee may be waived at Haven Media’s discretion and will not apply in cases of cancellation due to weather events.

• Property Access: Clients are responsible for ensuring that Haven Media has unimpeded access to the property at the agreed-upon time. Any delays or disruptions caused by the client may result in additional charges.

• Brief Submission: For larger projects, including all videography services, clients must submit a detailed brief to Haven Media no less than seven (7) days before the scheduled shoot. In the absence of a brief, Haven Media will proceed with the shoot and post-production at their professional discretion. Should the client request any revisions or additional edits beyond the work produced, these will incur a charge of one hundred and fifty dollars ($150) per edit.

Included Revisions: Each project includes one round of revisions at no additional cost. Any further revisions requested by the client will be charged at a rate of one hundred and fifty dollars ($150) per edit.

• Timeline: Haven Media will deliver the final images or videos within the timeframe agreed upon with the client. Delays caused by circumstances beyond Haven Media’s control, such as technical issues or client-related delays, will be communicated promptly.

• Method of Delivery: Final deliverables will be provided to the client in a digital format, typically via a downloadable link or Dropbox folder.

All intellectual property rights, including copyright, in the images and videos produced by Haven Media, remain the property of Haven Media unless otherwise agreed in writing. Clients are granted a non-exclusive license to use the images and videos for marketing and promotional purposes as specified in the contract. Any commercial use beyond this scope requires additional licensing and payment.

• Damage Liability: Haven Media shall not be held liable for any damage to the property during the shoot unless such damage is caused by gross negligence or willful misconduct on the part of Haven Media. Clients are responsible for ensuring that their property is safe and accessible during the shoot.

• Indemnity: The client agrees to indemnify and hold Haven Media harmless from any claims, damages, or expenses arising from the use of Haven Media’s services, including any claims related to intellectual property rights, privacy, or the unauthorized use of the images or videos.

Haven Media may utilize third-party services or platforms for the delivery of certain services (e.g., cloud storage, editing software). Haven Media is not responsible for any issues, disruptions, or data loss caused by these third-party services.

Unless otherwise requested in writing by the client, Haven Media reserves the right to use any images or videos created for a client’s project in its portfolio, on the Haven Media website, and across social media channels for marketing and promotional purposes.

The client will have the opportunity to review and approve the final deliverables. Once a project is approved and signed off by the client, any further changes or edits will be considered additional work and will be charged accordingly.

Haven Media adheres to strict health and safety protocols during all shoots. Clients must ensure that all shoot locations comply with health and safety regulations and that Haven Media is informed of any potential hazards.

If a client wishes to reschedule a shoot, at least twenty-four (24) hours' notice must be provided. Rescheduling within this time frame, excluding weather-related reasons, will incur a fee of fifty percent (50%) of the total job cost. If the reschedule is due to a weather event, the fee will not apply, and Haven Media will accommodate the new date and time at no extra charge.

For jobs located outside a thirty (30) kilometer radius from Mackay CBD, the client will be responsible for reimbursing Haven Media at a rate of one dollar ($1) per kilometer traveled to and from the location.

These terms and conditions, together with any written agreement or contract, constitute the entire agreement between Haven Media and the client. By booking and working with Haven Media, the client agrees to and accepts all terms and conditions outlined herein. This agreement supersedes any prior discussions, agreements, or understandings, whether oral or written.

Both Haven Media and the client agree to comply with all applicable laws and regulations during the course of their work together. Any violation of these laws may result in the termination of the agreement and legal consequences.

Haven Media shall not be liable for any failure to perform its obligations under these terms and conditions due to circumstances beyond its reasonable control, including but not limited to natural disasters, illness, or other unforeseen events.

These terms and conditions are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Queensland.

In the event of any dispute, controversy, or claim arising out of or in connection with these terms and conditions, the parties agree to first attempt to resolve the matter through good faith negotiation or mediation before resorting to legal proceedings.

Haven Media reserves the right to amend these terms and conditions at any time. Any amendments will be communicated to clients via the Haven Media website or by email and will take effect immediately upon such communication.
